The below terms and conditions, together with any policies referenced herein describe your rights and responsibilities when you use the Services. By accessing, browsing, or using our website, purchasing our pet clothing products, or engaging with any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any other referenced policies. If you are using the Services on behalf of a third party, you represent and warrant that you have the authority to bind that third party to these Terms. If you do not agree to these Terms, you must immediately cease using all Services.

Products and Services / Order Acceptance

We offer a range of pet clothing products (including dresses, jumpsuits, overalls, and themed outfits) and related services through our website and physical store. We strive to ensure that all product information (including descriptions, sizes, colors, and prices) is accurate and up-to-date. However, we do not guarantee the absolute accuracy of all content, and minor discrepancies may occur.

Order acceptance is subject to availability of products and our verification of your payment information. When you place an order, you submit an offer to purchase our products. We reserve the right to accept or reject your order in our sole discretion, without liability. If we reject your order, we will notify you promptly and issue a full refund if payment has already been processed. Once your order is confirmed and payment is verified, a binding contract between you and us is formed.

Pricing and Payment

All product prices are displayed in the applicable currency and do not include any applicable taxes, unless stated otherwise. We reserve the right to adjust prices at any time without prior notice, but such adjustments will not affect orders that have already been confirmed. We accept various secure payment methods, including American Express, Diners Club, Discover, JCB, Maestro, Mastercard, and Visa.

You agree to provide accurate and complete payment information, and to ensure that you have sufficient funds or credit to cover the total cost of your order. We do not store full credit card details, and all payments are processed through trusted third-party payment processors in compliance with industry security standards.

Shipping Policy

We offer shipping services within Canada. All orders placed through our platform are processed within 1–2 business days , with an estimated delivery time of 3 to 7 business days. We partner with UPS to ensure that your delivery is both fast and secure. All orders shipped within Canada qualify for free shipping, with no minimum purchase requirement. Please note that delivery times may be extended in the event of unforeseen circumstances (such as severe weather, logistical disruptions, etc.). We will notify you promptly should any significant delays occur.

Refunds and Returns Policy

You may request a return or exchange within 30 calendar days from the date of receiving your pet clothing order. To be eligible, products must be unused, unwashed, in their original condition with all tags and packaging intact, and accompanied by a valid proof of purchase.

Returns and exchanges are accepted for defective, damaged, incorrect, or ill-fitting products (provided the size was selected based on our size guide). Custom-made products are non-returnable unless defective. To initiate a return or exchange, contact our customer service to obtain a return authorization, then ship the product to our store address. Refunds will be processed within 3-5 business days after we inspect the returned product, and credited back to your original payment method. Shipping fees for returns/exchanges are covered by us if the issue is our error; otherwise, you are responsible for shipping costs.

Intellectual Property

All intellectual property rights (including trademarks, copyrights, logos, designs, text, images, and software) related to our website, products, and Services are owned by PET'S CANADA SAC or our licensors. You may not copy, reproduce, distribute, modify, or use any of our intellectual property without our prior written consent. Unauthorized use of our intellectual property may constitute a violation of applicable laws, and we reserve the right to take legal action.

Limitation of Liability

To the maximum extent permitted by law, Thunder Pet, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors—as well as Shopify and its affiliates' respective personnel—shall under no circumstances be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages. This applies whether such liability is based in contract, tort (including negligence), strict liability, or otherwise, provided that it arises from your use of any of the services or any products procured using the service; and regardless of whether such claim is in any way related to your use of the service or any product—including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service—even if we have been advised of the possibility of such damages.

Termination

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

The following sections will continue to apply following any termination: Intellectual Property, Limitation of Liability, Indemnification, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

Indemnification

You agree to indemnify, defend and hold harmless Thunder Pet, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

Governing Law

These Terms of Service and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or in connection with these Terms of Service shall be brought exclusively in the courts of Ontario, Canada, and you submit to the exclusive jurisdiction of such courts.
